We strive to display the colors, sizes, and images of our live flowers, trees, and herbs and arrangements as accurately as possible. However, we cannot guarantee that your device’s display of any color or image will be completely accurate.
Please note the following regarding our live products:
Natural Variations: Flowers are natural, living products. Variations in color, bloom stage, size, stem length, and foliage are normal and do not constitute a defect.
Seasonal Substitutions: Due to the seasonal nature of agriculture and supply chain fluctuations in Kenya, a specific flower variety may occasionally be unavailable. In such cases, we reserve the right to substitute a flower or foliage with one of equal or greater value and similar aesthetic style, unless otherwise specified at the time of order.
Vase Life: The longevity of cut flowers depends heavily on post-delivery care (water quality, temperature, trimming, and avoidance of direct sunlight/heat). We provide care instructions with our arrangements, but we do not guarantee a specific vase life beyond the natural limits of the flora.
3. Limitation of Liability
To the fullest extent permitted by the laws of the Republic of Kenya, Jowaki Gardens shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of this website or your purchase of our products.
Our maximum aggregate liability for any claim related to an order shall not exceed the total purchase price paid by you for the specific product(s) giving rise to the claim.
We are not liable for:
Allergic reactions to pollen, fragrances, or specific plant materials.
Damage or wilting caused by the recipient’s failure to accept delivery, improper storage after delivery, or failure to follow provided care instructions.
Delays or failures in delivery caused by force majeure events, including but not limited to extreme weather, severe traffic congestion, strikes, civil unrest, or third-party courier failures (for upcountry deliveries).
